Limitations of Tax Filing Support at Wingspan
Limitations of Our Service
While we aim to cover a broad range of needs, the following are areas where our current services do not extend:
-
1099-NEC and T4A Support: We exclusively support 1099-NEC forms and Canadian T4A forms (starting tax year 2023). Other 1099 forms are not within our service range.
-
Backup Withholding: Wingspan does not support Form 1099 filings that report non-zero federal income tax withholding or state tax withholding dollar amounts.
-
U.S. and Canadian Contractors: Services are limited to U.S. tax filings (1099-NEC) and Canadian tax filings (T4A). Other international tax forms aren't supported.
-
Limited International Mailing: Wingspan provides mailing services for addresses within the United States and Canada (for T4A forms). Mailing services are not available for other international addresses.
-
Specific Exclusions for 1099-NEC: Wingspan's support for 1099-NEC filings does not extend to certain edge cases. These include, but are not limited to, requirements such as filing for law firms even if they are incorporated, complex payment structures that do not fit standard contractor arrangements, or special circumstances involving agricultural or fishing payments. Our platform is not equipped to handle these nuanced scenarios, which often require specialized handling and reporting.
-
SSN and EIN Acceptance: Our system is set up for Social Security Numbers (SSN) and Employer Identification Numbers (EIN). Individual Taxpayer Identification Numbers (ITIN) aren't supported.
-
Specific Exclusions: Certain filing scenarios, like those for legal services, are beyond our scope.
-
Entity Changes During the Year: Wingspan does not support scenarios involving mid-year entity changes. In cases where payments need to be split across two entities within the same year, a correction will be necessary to accurately reflect these separate payments.
-
Multi-State Filings: Wingspan does not support Form 1099 filings that report to multiple states.
-
U.S. Only Payers: We only support 1099-NEC filings from payers with a U.S. address and EIN.
-
W-8 Exceptions and Withholdings: Wingspan does not handle W-8 exceptions or withholdings. This includes processing any special circumstances or reduced withholding rates related to W-8 forms, as well as managing any withholding requirements associated with these forms.
-
Limited W-8 Form Support: While we can collect W-8 forms, we do not process any exceptions, special circumstances, or reduced withholding rates related to these forms.
-
Limited International Income Reporting: We only support T4A forms for Canadian contractors. We do not support reporting of other foreign-sourced income or special reporting requirements for global contractors working outside the US and Canada.
-
Limited International Tax Withholding: We do not calculate, withhold, or remit taxes for non-US/non-Canadian jurisdictions. This includes VAT, GST, or any other country-specific tax requirements.
-
Limited Support for Tax Residency Issues: We do not provide guidance or support for determining tax residency status for contractors working across multiple countries.
-
No International Labor Law Compliance: Our system does not track or ensure compliance with labor laws, work permits, or visa requirements for global contractors.
-
Limited Support for International Tax Treaties: We do not provide advice or support regarding the application of international tax treaties or how they might affect contractor payments and tax obligations.
-
No Form 1042 Filing: Wingspan's tax filing software does not include services for filing Form 1042, which is used for reporting certain types of income paid to foreign persons.
-
No T4A-NR Support: We do not offer support for filing T4A-NR forms, which are used to report payments to non-residents for services performed in Canada.
-
Limited Cross-Border Payment Reporting: Our system handles T4A reporting for Canadian contractors but does not support reporting requirements for other countries.
-
No FATCA Compliance: We do not offer services related to Foreign Account Tax Compliance Act (FATCA) reporting requirements.
-
No CP2100/CP2100A Notice Support: Wingspan does not provide assistance or guidance regarding IRS CP2100 or CP2100A notices, which are sent when there's a mismatch between the name/TIN combination reported on 1099 forms and IRS records. As we are not tax advisors, we cannot provide specific guidance on how to respond to these notices or assist with the B Notice process that may follow. Please consult with a qualified tax professional for assistance with these notices.
-
No Permanent Establishment Risk Assessment: Our system does not assess or manage risks related to creating a permanent establishment in foreign countries through contractor relationships.
-
No Support for Equalization Payments: We do not handle tax equalization or tax protection calculations for global contractors.
-
Limited Payroll Tax Support: Our system does not manage complex payroll tax situations that may arise with global contractors, such as social security totalization agreements.
-
No Combined Entity Reporting: Wingspan does not support combined entity reporting or filing consolidated 1099 forms that include amounts from multiple entities, even with supporting IRS statements.
-
No Rev. Proc. 99-50 Statements: We do not prepare or file statements under Revenue Procedure 99-50 or similar IRS procedures for combined reporting scenarios.
